It is the most critical component of the investment process that needs to be checked and rechecked before finalising any decision. Similarly, real estate investments call for the same. Before making any purchase, the buyer should look at the whole picture and ensure that the property is under proper legal and record check. Verification at every stage is imperative for safety and security in the future. Here is a checklist of documents that you should keep handy if you are looking for a plot for sale in Gurgaon or anywhere else in the country -

Title Deed

This particular document ensures that the seller is independent of the house on a legal scale. Bringing in a lawyer for consultancy here would be a wise decision. The original document of the deed should be reviewed, and the property should be in the seller’s name. Besides this, the seller should be the sole owner of the property and should have every legal right to sell it. The same can be monitored by checking the government’s website for registration.

Certificate of Encumbrance

This document is necessary for transferring the property from the seller to the buyer and acts as n evidence of authentic ownership. It is issued by the sub-registrar’s office for a designated time period, which is further carried forward on the basis of property records. This document is also necessary for availing of home loans and other related facilities.

Order for NA land

By default, land in India is considered to be under ‘agricultural property’ unless the government specifies otherwise. For all agricultural purposes, this land can be used, but if it has to be used for reasons other than agriculture, then it has to be first turned into an NA or ‘Non-Agricultural’ land. If you are looking for plots in Dwarka Expressway or plots in Gurgaon, ensure that you do proper research here because there are specific terms and conditions. All NA land cannot be used for building residential properties.

Land deed (Original)

Also known as the 7/12 document, this document has vital importance. You must inquire about everyone’s land deeds in the past — inclusive of the present and all previous owners.

POA

For non-residential Indians, the seller needs to ask for the Power of Attorney. The POA is a legal document in the form of a letter that enables you to pass on the responsibilities to another organisation or person to look after your property affairs, medical affairs, and related finances, in case you are not present. The POA has certain T&Cs that the authorised person needs to adhere to.
